An important legal decision has been recently made in the unfortunate battle over the brilliant mare Cherie. Owner and breeder of Cherie, Klaus and Angela Hoeber, have won their case versus Gisela Carstens
in the court hourse of Lubeck, Germany. In court, it was decided that Carstens, who up till 5th January 2004 determined at which international shows Cherie was to participate, has to give Cherie's pass to the Hoebers.
Angela and Klaus Hoeber bred the Hanoverian mare Cherie (Don Primero x Lanthan) and are still her owners . However several years ago, the Hoebers sold the "sport rights" to the mare to sponsor Gisela Carstens, who would handle the "marketing" of the horse. The Hoebers and Carstens agreed to place Cherie in training with Karin Rehbein. This decision was fruitful as Cherie became the World Young Horse Champion and was an undefeated Prix St Georges winner in 22 classes so far.
In the summer of 2003, a dispute between the two parties about the boarding of the horse arose. This soon resulted into a legal matter which still has not come to a final end after the settlement in Lubeck. Right after the Lubeck verdict Carstens' lawyer, the renowned Mr. Oexmann, told that Cherie's pass has been lost. Klaus Hoeber replied that he will send out the police. "We want to receive the pass at the competition in Verden," was Klaus Hoeber's firm answer.
